Rights & Duties

In the book of Civil Rights ('Burgerlijk Wetboek'), the right to rent is defined in article 7:201 BW: "Rent is the agreement, in which one party, the landlord, obligates himself to an other party, the tenant, to let him use an object or part of an object, for which the tenant obligates himself to a compensation."

The right to rent defines the duties of both landlord and tenant.


The landlord is obliged to:

  • make any necessary repairs to the apartment within a reasonable period of time
  • ensure that the rented property is available and ready for the tenant when the contracted rental term begins
  • repair any damages and solve any problems, such as noisy neighbours, which affect the client but were not caused by them

 

The tenant is obliged to:

  • pay the rent
  • be a 'good' tenant / be well behaved
  • allow repairs to be made to the property when necessary
  • abide by the terms and conditions of the rental contract
