Rights & Duties of the Landlord

The Italian civil code outlines the exact duties and responsibilities of landlords, but in summary:

 

 

 

  • The landlord should ensure that the flat is in good condition at the beginning of the rental term, carry out any necessary structural maintenance and ensure that the tenant has a safe and comfortable place to live.

  • The landlord is entitled to request that the flat is returned to them (at the end of the rental term) in the condition in which it was rented out. If the tenant has made changes to the property, the landlord can ask for these changes to be reversed. However, if the landlord decides that the changes are an improvement, they should reimburse the tenant for the cost of materials and their hours of work.

  • Should the property be sublet, the original terms and conditions of the contract apply and rent must be paid directly to the landlord.

  • Within two days of the rental contract being validated, the landlord must inform the police that the tenant is or will be living at the property.
