State Pension and Civil Partnerships

Since December 2005 it has been possible for same-sex couples over sixteen years old to register their relationship as a civil partnership. This offers same-sex couples equality with married couples in terms of rights and entitlements. In terms of the State Pension, civil partners should find that they are afforded the same rights as a husband has once their relationship has been legally registered. Civil partners should find that they are treated the same way as heterosexual married couples from 2010, when there are procedures in place to ensure equal treatment of men and women. Your civil benefits may enable you to inherit your partner's State Second Pension (see State Second Pension) or entitle you to a basic State Pension based on their National Insurance record (see The Basic State Pension). On the other hand however, you may find that your partnership means that you have certain ongoing financial obligations towards your civil partner even after you separate.
