Most people in the UK will be involved in an accident at some point in their lives. Fortunately, the majority of these accidents do not involve serious injuries: the most common car injury is whiplash.

If you suffer whiplash as a result of a road traffic accident that was not your fault, you may be able to make a personal injury compensation claim: the cost of doing this is covered by your Motor Legal Protection insurance. It should be noted that you are required to produce evidence from a medical professional of your injuries.

Compensation claims in the UK can only be made where a third party was at fault. If you were the driver of a vehicle and you were not to blame, you would make the claim against the other driver. If you were a passenger, you could claim from the driver of the car you were travelling in. In most cases the third party would then pass on the claim to their insurance company.

Once you are covered by Motor Legal Protection, the cost of hiring a solicitor to present your case is paid for by your policy. On your behalf, the solicitor claims for any losses that you incurred as a direct or indirect result of the whiplash injury, including: non-emergency medical fees, out-of-pocket expenses (such as travelling to and from the hospital) and lost days at work.

Other expenses you are entitled to claim as part of you car accident compensation in the UK include:

  • Vehicle Damage – any damage or replacement is costly: you are entitled to claim this cost back from the third party who caused the accident.
  • Replacement Transport – any costs incurred to provide replacement transport as a result of the loss of use of your car, which could include cost of car hire.
  • Vehicle Recovery – there is a cost for removing your vehicle from the scene of the accident; the party responsible will pay for this.
  • Fuel in the Tank – if your vehicle is written-off, you can claim the cost of the fuel that was in the tank when the accident occurred.
  • Medical and Travel Expenses – any medical expenses incurred for treatment of your injuries as a result of the accident can be claimed, along with the cost of travelling to and from the hospital or your doctor.
  • Loss of Income – any working days lost as a result of the accident can also be claimed in terms of their affect on your net pay. If you had any holidays booked you are also entitled to a refund of the cost if you were unable to go on that holiday due to the accident: this also extends to loss of enjoyment on holiday in the event that you were able to go, but could not enjoy it to the full due to your injuries.
